Lumpkin County Bank Online Banking
Terms and Conditions
This Agreement describes your rights and obligations as
a user of Lumpkin County Bank's Online Banking service. It also describes
the rights and obligations of Lumpkin County Bank. Please read this carefully.
By requesting and using any part of the Online Banking service, you agree
to comply with these terms and conditions.
DEFINITIONS
- Online Banking is Lumpkin County Bank's Internet based service providing
access to your online account(s).
- Online Account means any Lumpkin County bank account from which you
will be accessing information or conducting transactions from.
- Access ID is the name you choose to use to log into Online Banking.
- Password is a series of numbers and letters that you select as a code
to establish a connection to the service.
- Business Days are Monday through Friday, excluding Saturday, Sunday
and federal banking holidays.
- Cut Off is that time which Lumpkin County Bank turns over to the next
business day. Lumpkin County Bank's cut off time is 2:00pm.
- "We" or "us" refer to Lumpkin County Bank, which
will provide the service under this Agreement.
ACCESSING YOUR ACCOUNTS
In order to activate your Online Banking service, you must have at
least one checking, savings, certificate of deposit or loan with Lumpkin
County Bank. As a customer of Lumpkin County Bank, you may access your
accounts by using an access ID and online password (PIN) and by paying
any required monthly fee as described in this Agreement.
Safety of our customers' accounts and account information is of vital
importance to us. We go to great lengths to protect the confidentiality
and security of your account(s) and we ask you to do the same. You agree
not to allow anyone to gain access to the Online Banking service or
to let anyone know your access ID and password used with this service.
You should keep your ID and password in a secure location. Any person
having access to your Lumpkin County Bank Online Banking ID and password
will be able to access the Online Banking service and perform all transactions,
including reviewing account information, sharing account information
with third parties and making transfers out of your account(s). You
are liable for all transactions made or authorized using your ID and
password. If despite the Bank's advice, you give your ID and password
to anyone, you do so at your own risk.
You will receive an application for Lumpkin County Bank Online Banking,
which you must fill out and return to a customer service representative
at either of our Lumpkin County Bank branches.
Your Access ID must be at least six (6) digits.
The Password requirements are as follows:
- Minimum Password Length: 6 digits
- Maximum Password Length: 10 digits
- Number of Numeric Characters required: 4 to 8
- Number of Alpha Characters required: 2
- Passwords are case sensitive-must be entered exactly as input with
upper and/or lower case characters
- Passwords can be changed at any time by the account holder through
the Online Banking service
- Password expires every six (6) months
- Number of invalid log on attempts: 3
- Session Limit: 30 minutes
- Inactivity Time Limit: 10 minutes(after ten minutes of inactivity
you will be logged off of the Online Banking service)
If you suspect that an unauthorized person has access to your ID and
password please contact Lumpkin County Bank immediately, Monday through
Friday, 8:30am to 5:00pm, at (706) 864-2265 and tell a bookkeeping representative
about the problem.
ONLINE BANKING TRANSACTIONS
You may use your personal computer to view:
Free Checking
New Age Account
NOW Account
Personal Line of Credit
Money Market Investment Account
Savings Account
Business Checking
Certificate of Deposit Account
Consumer Loans
Business Loan
New services will add as they become available.
You may use Online Banking to view account(s) balances and transaction
history; transfer funds from checking and savings into other Lumpkin
County Bank checking and savings which belong to you; make loan payments
using a Lumpkin County Bank checking or savings account; transfer funds
from your personal line of credit.
Because regulations require Lumpkin County Bank to limit pre-authorized
transfers (including Online Banking transfers), the following limitations
apply:
· Savings Account: You can make no more than three (3) transfers
or withdrawals per quarterly statement cycle. A per item fee of $2.00
will be charged for each debit transaction in excess of three (3) during
a quarterly statement cycle.
· Money Market Investment Account: You can make no more than
six (6) transfers per monthly statement cycle by pre-authorized or automatic
transfer or by telephone or Online Banking, and no more than three (3)
of the six (6) permitted transfers may be by check, draft or debit card.
FEES AND CHARGES
Lumpkin County Bank reserves the right to cancel your Online Banking
service at any time without notice due to insufficient funds in one
or more of your accounts. After cancellation, service may be reinstated
at our discretion provided that funds are available to cover the cost
of any fees and/or pending transfers. To reinstate your service, contact
Lumpkin County Bank at (706) 864-2265.
If you do not access your accounts via your Online Banking service
for any consecutive three (3) month period, Lumpkin County Bank reserves
the right to disconnect your service. (See above paragraph for reinstatement
of service information.)
You agree to be responsible for any telephone charges or Internet Service
Provider charges that you incur by accessing your account(s) on Lumpkin
County Bank Online Banking service.
If you wish to cancel your Lumpkin County Bank Online Banking service,
please contact Lumpkin County Bank at (706) 864-2265 or send us written
cancellation instructions to: Lumpkin County Bank, P.O. Box 6, Dahlonega,
GA 30533.
HOURS OF OPERATION
You may access Lumpkin County Bank Online Banking service seven days
a week, twenty-four (24) hours a day. Necessary system maintenance will
be scheduled for hours during which system traffic is normally at a
minimum. If the system is unavailable due to an unanticipated problem,
you may use the automated telephone response system (Telephone Banking),
one of our ATM machines or one of branches, during regular banking hours,
to conduct your business.
ADDITIONALLY
You may access any eligible Lumpkin County Bank account or loan on
which you are an owner or signor to receive transaction history and
balance information. The balance and account history will show the current
balance of the account, including any transactions conducted prior to
the inquiry. In progress returns due to non-sufficient funds or stop
payments may not be reflected in the inquiry.
Funds transferred between related accounts initiated on your computer
using Online Banking and received by the bank before 2:00pm EST Monday
through Friday will be effective on the current business day. Transfers
processed on your computer using Online Banking and received after 2:00pm
EST Monday through Friday or all day Saturday, Sunday and federal banking
holidays will be effective the following business day.
UNAUTHORIZED TRANSACTIONS
You must notify Lumpkin County Bank immediately if you suspect that
another person has improperly obtained use of your ID and password.
You must also notify us if someone has transferred or may transfer money
from your bank account(s) without your permission, or if you suspect
any fraudulent activity related to your account(s). You should reveal
your account(s) number(s) only to legitimate entities for purposes you
authorize, such as automatic payments to an insurance company. To notify
us, call Lumpkin County Bank at (706) 864-2265.
Federal law requires that if you believe your password has been lost,
stolen or compromised and you tell us within two (2) business days after
you learn of the loss or theft, you can lose no more than $50.00 if
someone used your Online Banking password without your permission.
Please tell us AT ONCE if you believe your password has been lost or
stolen. Telephoning is the best way of keeping your possible losses
down. If you do not notify us promptly, it is possible that you could
lose all the money in your account(s), plus any personal line of credit.
To notify us, call Lumpkin County Bank at (706) 864-2265.
If you do NOT tell us within two (2) business days after you learn
of the loss or theft, and we could have stopped someone from taking
money without your permission had you told us, you could lose as much
as $500.00.
If your statement shows withdrawals, transfers or purchases that you
did not make or authorize, please notify us at once. If you do not notify
us within sixty (60) days after the paper or online statement was sent
to you and we could have stopped someone from taking money if you had
told us in time, you may not get back any money lost after the sixty
(60) days. If extenuating circumstances, such as a long trip or hospital
stay, kept you from notifying us, the time periods in this section will
be extended.
ERROR RESOLUTION
If you believe that there is an error regarding your account(s) in
conjunction with Lumpkin County Bank Online Banking, it should be handled
as follows:
· Call Lumpkin County Bank and inform a bookkeeping representative
about the discrepancy at (706) 864-2265
· Write a letter explaining the error and mail it to Lumpkin
County bank, attention: Bookkeeping Department, P.O. Box 6, Dahlonega,
GA 30533
We must hear from you no later than sixty (60) days after we send the
paper statement or electronic statement on which the problem or error
in question occurred. If you notify us verbally, we may require that
you send us your problem in writing within ten (10) business days.
When you write us about your problem or error, please:
· Include your name, address and account number
· Describe the error or transaction in question, and explain
why you believe it to be an error
· Tell us the dollar amount of the error or transaction in question
We will tell you the results of our investigation within ten (10) business
days after we hear from you and we will refund any error plus interest,
if applicable, and fees imposed by us within one (1) business day and
provide you notice within three (3) business days. If we cannot complete
the investigation within the ten (10) business days, we may take up
to forty-five calendar days from the time the bank received your notice,
to investigate your complaint or question. If we decide that we need
extra time, we will provisionally credit your account within ten (10)
business days for the amount you think is in error, so that you have
use of the money during the time it takes us to complete our investigation.
Upon completion of our investigation we will notify you of our findings.
You may ask for copies of the documents used in our investigation.
If we do not complete a transfer to or from your Lumpkin County bank
account on time or in the correct amount according to our Agreement
with you, we will be liable for your losses or damages. However, there
are some exceptions. We will not be liable:
- If, through no fault of ours, you do not have enough money in your
account to make a transfer
- If legal order directs us to prohibit withdrawals from the account
- If your account is closed or it has been frozen
- If a hold has been placed on your account for uncollected funds
- If the transfer or payment would cause the account to become overdrawn
beyond the balance of the account plus any personal line of credit
- If you, or anyone you allow, commits fraud or violates any law or
regulation
- If you believe someone has accessed your accounts without your permission
and you fail to notify us immediately
- If any electronic terminal, telecommunication device or any part
of the electronic fund transfer system is not working properly
- If circumstances beyond our control, such as fire, flood, hurricane,
tornado, acts of war-declared or undeclared, prevent the transfer,
despite reasonable precautions taken by us
CONSUMER RIGHTS AND REPONSIBILITIES
In addition to this Agreement, you agree to be bound by and comply
with the Account Agreement and Account Disclosures, the rules and regulations
of the electronic transfer system and state and federal laws and regulations.
You, the consumer, are responsible for keeping your password and account
data confidential. We are entitled to act on transaction instructions
received using your password, and you agree that the use of your password
will have the same effect as your signature, authorizing the transaction(s).
If you authorize other persons to use your password in any manner, your
authorization will be considered unlimited in amount and manner until
you have notified us in writing, by telephone or in person that you
have revoked the authorization, changed your password and that you are
responsible for any transactions made by such persons until such time
as we receive and have time to act upon the notification that transfers
by that person, or instructions regarding your account, are no longer
authorized.
The bank reserves the right to terminate this Agreement and your access
to the Online Banking service in whole or in part, at any time.
The bank may assign certain of its rights and responsibilities under
this Agreement to independent contractors or other third parties.
LIMITATIONS ON BANKING LIABILITY
We will not be responsible for the following incidents, errors or failures:
Access
We will not be responsible for failure to provide access or for interruptions
in access to Online Banking at Lumpkin County Bank due to a system failure
or due to other unforeseen acts or circumstances.
Your Computer Equipment or Software
We will not be responsible for any errors or failures from any malfunction
of your computer or any computer virus or other problems related to
your computer equipment used with Lumpkin County Bank Online Banking
service.
We are not responsible for any error, damages or other losses you may
suffer due to the malfunction or misapplication of any system you use,
including your browser, your Internet service provider, your personal
financial management or other software or any equipment you may use
to access or communicate Lumpkin County Bank.
Warranty and Software Limitations
NEITHER WE, NOR ANY SOFTWARE SUPPLIER NOR ANY INFORMATION PROVIDERS MAKE
ANY WARRANTY, EXPRESS OR IMPLIED, TO YOU CONCERNING THE SOFTWARE, EQUIPMENT,
BROWSER OR OTHER SERVICE INCLUDING, BUT NOT LIMITED TO, ANY WARRANTY OF
MERCHANTABILITY OR FITNESS FOR PARTCULAR PURPOSE (OR NON-INFRINGMENT OF
THIRD-PARTY RIGHTS), UNLESS DISCLAIMING SUCH WARRANTY IS PROHIBITED BY
LAW.
Ownership of Website
The content and information on our website are owned by Lumpkin County
Bank, and the unauthorized use, reproduction, linking or distribution
of any portion is strictly prohibited.
Geographic Restrictions
Lumpkin County Bank Online Banking services described in this Agreement
and available on our website is solely offered to citizens and residents
of the United States of America currently residing in the United States.
Citizens and residents outside the United States may not be able to
access the Lumpkin County Bank Online Banking service.
CHANGES TO FEES AND OTHER TERMS
We reserve the right to change the fees or terms outlined in this agreement.
We will notify you thirty (30) days prior to implementation of changes
in a written notice or a statement stuffer and will also update this
Agreement if the changes to this Agreement are more restrictive than
those stated in this Agreement, or increase your responsibility for
unauthorized transactions. In the event that a change is necessary to
ensure the security of the online system, an immediate change may be
necessary and we will notify you within thirty (30) days after the change
is made by written notice or statement stuffer. You may choose to accept
or decline the changes by continuing or discontinuing the service. We
reserve the right to waive, reduce or reverse charges or fees in individual
situations. Changes and fees applicable to specific accounts are governed
by the applicable Account Disclosures.
SCOPE OF THIS AGREEMENT
This Agreement represents our complete agreement with you relating
to our provision of the Online Banking services at Lumpkin County Bank.
No other statement, oral or written, including language contained on
our website, unless otherwise noted, is part of this Agreement.
